Seller Terms of Service

1. Auctioneer of Record

All auctions conducted on pallet.bid are overseen by a South Carolina Licensed Auctioneer (SC #4674) in compliance with South Carolina Code Title 40, Chapter 6. By listing items on the Platform, Seller acknowledges and agrees that all auctions are conducted under the authority of the designated auctioneer of record.

2. Commission & Fees

Listing Fee: There is no fee to list inventory on pallet.bid. Sellers may list as many auctions and Buy It Now items as they wish at no cost.

Pallet Listings (Auction only):

  • Seller Commission: 7% of the hammer price (winning bid amount), deducted before payout.
  • Buyer's Premium: 12% charged to the buyer on top of the hammer price, retained entirely by pallet.bid.

Individual Item Listings (Auction or Buy It Now):

  • Seller Commission: 5% of the sale price, deducted before payout.
  • Buyer's Premium: 10% charged to the buyer on top of the sale price, retained entirely by pallet.bid.
  • Lot Fee: None. No per-item fees.

Stripe Processing: Standard Stripe payment processing fees apply and are borne by the Platform. Sellers receive their net payout (sale price minus applicable commission) via Stripe Connect.

3. Payouts

Seller payouts are processed via Stripe Connect Express. Funds are transferred to the seller's connected bank account after buyer payment is confirmed. Pallet.bid reserves the right to hold payouts for up to 7 calendar days from sale completion to allow for buyer dispute resolution.

Sellers are responsible for providing accurate banking information through Stripe Connect. Pallet.bid is not responsible for delays or errors caused by incorrect banking details.

4. Seller Responsibilities

  • Provide accurate, truthful descriptions of all listed items including condition, contents, and manifest details (where applicable)
  • Upload clear, representative photographs of the actual inventory being sold
  • Ship items or have pallets ready for carrier pickup within 2 business days of sale completion
  • Respond to buyer inquiries and platform communications within 2 business days
  • For pallets: maintain a safe, accessible loading dock or pickup area for LTL freight carriers
  • For parcel items: use the provided shipping label and drop off at the designated carrier location promptly
  • For pickup-only items: coordinate pickup with the buyer within 2 business days and have items accessible at the listed location
  • Comply with all applicable federal, state, and local laws including consumer protection regulations

5. Prohibited Items

The following items may not be listed on pallet.bid:

  • Firearms, ammunition, or weapons of any kind
  • Hazardous materials (flammable, corrosive, toxic, etc.)
  • Recalled products or items under safety alerts
  • Counterfeit, stolen, or unlicensed merchandise
  • Perishable food items or items requiring cold chain
  • Controlled substances, pharmaceuticals, or drug paraphernalia
  • Live animals or animal products requiring permits
  • Items that infringe on intellectual property rights

Pallet.bid reserves the right to remove any listing and suspend any seller found to be listing prohibited items, without notice or refund.

6. Indemnification & Hold Harmless

Seller agrees to indemnify, defend, and hold harmless pallet.bid, its owners, operators, employees, agents, and the auctioneer of record from and against any and all claims, demands, damages, losses, costs, expenses (including reasonable attorneys' fees), and liabilities arising out of or relating to:

  • The quality, condition, safety, or description of any merchandise listed by Seller
  • Any dispute with buyers regarding listed items, including but not limited to condition discrepancies
  • Any violation of federal, state, or local law by Seller in connection with listed merchandise
  • Any intellectual property infringement claims related to Seller's merchandise
  • Any injury, damage, or loss arising from the use of Seller's merchandise by any party

7. Listing Accuracy Warranty

Seller warrants that all listing descriptions, manifests, condition reports, and photographs accurately represent the items being sold. Material misrepresentation may result in immediate suspension, forfeiture of pending payouts, and potential legal action.

8. Shipping & Freight

Pallet Shipments: Pallets are shipped via LTL freight arranged through pallet.bid's integrated freight partner. Sellers must have pallets properly shrink-wrapped, labeled, and staged for pickup at the address provided during registration. Seller is responsible for ensuring pallets are freight-ready.

Parcel Shipments: Individual items sold with parcel shipping are shipped via USPS, FedEx, or UPS. Pallet.bid generates a prepaid shipping label after sale. Sellers must print the label, pack the item securely, and drop off the package at the carrier's location within 2 business days.

Pickup Only: Items listed as pickup-only do not require shipping. Sellers must make items available for buyer collection at the listed location within 2 business days and coordinate pickup logistics directly with the buyer.

9. Suspension & Termination

Pallet.bid may suspend or terminate a seller's account at any time for violation of these terms, including but not limited to: inaccurate listings, failure to ship within 2 business days, excessive buyer complaints, listing prohibited items, or failure to maintain accurate Stripe Connect information. Outstanding payouts for completed, undisputed sales will be paid within 30 days of termination.

10. Tax Responsibilities

Seller is solely responsible for all income tax reporting and obligations. Stripe will issue 1099-K forms as required by federal law. Seller acknowledges that pallet.bid does not collect or remit income taxes on behalf of sellers.

11. INFORM Consumers Act Compliance

In compliance with the INFORM Consumers Act, all sellers must provide verified identity and business information as part of the application process. This information is verified by pallet.bid and/or Stripe during the onboarding process.

12. Dispute Resolution

Any dispute arising out of or relating to these Seller Terms shall first be submitted to good-faith mediation in South Carolina. If mediation fails to resolve the dispute within 60 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association, to be conducted in South Carolina. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

13. Governing Law

These Seller Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict of law principles.

14. Modifications

Pallet.bid reserves the right to modify these Seller Terms at any time. Sellers will be notified of material changes via email and in-platform notification at least 30 days prior to the effective date of the changes. Continued use of the Platform after the effective date constitutes acceptance of the modified terms.
